The United States Constitution (the Law) requires an enumeration of the population every 10 years for the purpose of apportioning the House of Representatives.

The Title 18 reference is not specific but would increase Title 13 penalties.

The 4th Amendment to the Law gives the people the right “to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures.”

Mandatory Census Bureau Survey

Over the last decade I have had my personal information “possibly compromised” by the Veteran's Administration, the SC Department of Revenue, and the US Department of Energy. This week my wife and I received notification from the US Department of Commerce Director, U.S. Census Bureau that our address had been randomly chosen to receive “a very important national survey, the American Community Survey.”

The Constitution specifically requires an “enumeration” every 10 years for the purpose of apportioning the House of Representatives. The Federal Government has vastly expanded this function to the extent that census information is withheld from the public for 72 years due to privacy reasons. The currently available census data is 1940. The data is in high demand, and computer servers nearly crashed several years ago when the 1940 census became available for the first time.

Businesses and financial markets have come to depend on information collected by the government. At 10:30AM every Wednesday the Weekly Petroleum Status Report is released by the Energy Information Administration within the Department of Energy. The Bureau of Labor Statistics releases the unemployment statistics and the Census Bureau the Gross Domestic Product estimates along with many other measures on a regular basis. All this and more is available to the political party in power on a 24/7 basis. Other agencies like the VA, IRS, HUD, HHS, FBI, NSA etc have much more data on individual Americans. This information gathering costs taxpayers about one billion dollars each year. It is hard to know exactly since the government does not budget and does not use Generally Accepted Accounting Principles.

As our lives become increasing digitized, it is important to remember that fallible humans are collecting and using this data – sometimes for nefarious purposes. Big Brother is definitely real and active.

Tyranny in America

In 1967 I took an oath to support and defend the Constitution against all enemies foreign and domestic. Attorney General Holder and his boss took the same oath. I meant what I said. Holder has decided which laws to enforce and which to ignore.

Imagine if the ranking lawman in your county decided not to enforce some laws. Suppose the Sheriff or District Attorney decided that rape is just "boys being boys" and arrested no one and prosecuted no one. We would fire them. We are not under Sharia law where a girl who is gang-raped is stoned to death for fornication!

Holder and Obama have done the same with DOMA and immigration laws. Representative Bachman has finally submitted articles of impeachment against Obama. There have been many hearings in Congress about "fast and furious" but no articles of impeachment against Holder.

I understand that neither would be removed from office. Only two presidents have been impeached, and neither was removed from office. Nixon resigned and was pardoned by Ford. The speeches in the House of Representatives are still recorded in the Federal Register for the public to read.

Offenses of government officials against the people should not be ignored. That invites tyranny. In 1986 President Reagan agreed to amnesty for 2.5 million illegal aliens in exchange for a tough immigration law. The law was never well enforced. The result is tens of millions of illegal aliens in our country today. The government has blurred the distinction between those illegal aliens and those who took the legal steps to become citizens and swore allegiance to the United States. The difference is like that between a burglar and an invited house guest!

The Constitution is the Law of our land. If laws are passed by the Congress and President and not enforced, then we are no longer a law-abiding nation. Tyranny will be the result if we who defend the Constitution keep silent.

Government Shutdown "crisis"

The United States is bankrupt. Life goes on as “normal” because there is great flexibility in such a huge economy. There is currently a “budget crisis” and a looming “debt-limit crisis.” These are a problem because Congress and the President planned it. The President sent his budget proposal to Congress in the spring. It was late, but since an actual budget – with 13 separate appropriations bills – has not been signed into law for 4 years - the President's tardiness is moot.

Both parties blame each other for the shutdown. The fact is that they have had over 5 months to debate the budget. The House of Representatives has produced numerous budget bills only to see them tabled by the Democrat-controlled Senate. Since the last budget passed was the Pelosi-Reid-Obama budget, the Democrats are happy to “continue it” with a constant stream of CRs.

The real debate is over the type of government we actually have. The Democrats say that America is a democracy, and must operate by “majority rule.” The Constitution is a “dated” document and is irrelevant now. The Conservatives say that America is a constitutional republic with “limited government.” A century ago, Progressives were successful in reducing the power of the states with the 17th Amendment. Senators had been elected by state legislatures. Now both Representatives and Senators are “popularly elected.” Only their terms of office are different. The problem with democracies is they fail when the people realize that they can write checks to themselves.

Democrats make a heartwarming appeal for the “little guy.” In the 1930s it was electricity and secure retirements for all. From the 1960s to present it was an end to poverty, jobs and promotions through race preference for minorities and medical care for all. For several decades it has been telephones for all. The Progressive “solution” is always according to Karl Marx's philosophy of from those who have; to those who “need.” Marxism fails when you run out of other peoples' money (Thatcher). Progressives believe that individual responsibility and free-markets are wrong. A marriage with husband and wife is wrong because “it takes a village to raise a child.” There is power in the union of workers and in the “collective.”

We have clear examples of implementations of fascism, communism and socialism which failed. Our constitutional republic with a free-market economy has succeeded well. Our forefathers believed in the inherent sinfulness of man/woman, and the need for checks and balances. That rule of law is rarely practiced today.

Why is America Recovering Despite Obama?

Bill Clinton vetoed the fiscal policies of the conservative Congress twice in 1996 before finally accepting the policies. He then took credit for the surpluses that the policies produced.

Some ignorant people will give Obama credit for the current “recovery.” If presented with the facts, then it would be hard to do so. Consider unemployment in Yuma, AZ of 31.8% and unemployment in Bismarck, ND of 2.8% from the BLS report for June. If Obama is responsible for a 7.4% national rate, then he is also responsible for the 31.8% rate in Yuma The real reason is that new technologies in the “carbon-based” industries have given us an energy boom. Obama has been fighting any progress with a carbon tax proposal, huge subsidies to competing energy sources, and delays/prohibitions for obtaining resources from public lands and cheap and efficient distribution methods (pipelines). The oil imports have decreased more than 1 million barrels/day over the last several years (eia.gov). This amounts to money for over hundreds of millions of barrels of oil at $100/barrel which stays in the United States instead of subsidizing those who hate us. Those billions each year compose capital which can be used to create jobs.

Obama has surrounded himself with academics and out-right socialists who favor central planning over free-market economics. They claim that deficit spending (stimulus) by government and tight controls bring the nation out of recessions. The fact is that Hoover and FDR; Bush and Obama both tried stimulus spending and high wages. We know what happens because it has been tried before. Millions of Americans have suffered. The wealthiest period in America was the six years under President Coolidge. We had surpluses every year and individual wealth rapidly increased. Americans borrowed money to invest in America believing the boom would last forever (sounds like house prices never decrease?). Alan Greenspan would describe them as “irrationally exuburant.” The crash came under Hoover who Coolidge dubbed “wonduh boy.” Coolidge had been blamed as a “do-nothing” while Hoover, FDR, Bush and Obama were type-A interventionists.

The reference economist of 1776 was Adam Smith. Twentieth century economists Hayek and Mises saw the flaws in Keynes ideas and their use in Europe. Melowese Richardson Convicted of Voter Fraud in Ohio

Last week an Ohio judge sentenced Ms. Richardson to five years in prison for voting 6 times in a single election. Ohio was a critical state in the 2012 Presidential election. If the votes in only 4 states - Ohio included - were reversed, then Mitt Romney would have won. More of these criminals need to go to prison for voter fraud to diminish!

Will the United States Follow Detroit?

Detroit, once the fifth-largest city in America, has filed for bankruptcy. Hopefully the federal government will not bail out decades of mismanaging politicians with federal taxpayer dollars. As with other cities whose elitist leaders seek to centrally control all aspects of citizens' lives while lacking the competence to do so, Detroit is bankrupt. The producers have left the once-great city of 1.8M leaving less than 700,000 – many who are parasites depending on the city teats. This did not take place quickly. It took over 60 years! It is similar to the current situation at the federal level. Hiring and promotions have been based on race instead of competence, while pay, tenure and benefits have been extraordinary. Parkinson's Law may also be used to explain the situation – especially the number of “special assistants to the POTUS” (czars).

The Obama administration ignored centuries of contract law in the GM bailout. Union members were moved to the head of the line, and creditors were pushed back. Most in Detroit are also friends and supporters of the Democrat Party. Will the federal courts follow the law? Will the lawyer-in-chief provide additional guidance?

Religious Liberty In the U.S. Armed Forces from FRC

America Is Bankrupt and Sinking Fast

Where is the outrage? The Owe-bama administrations have been in a full-court press for wealth redistribution since January 2009. Some readers from the South say 'We elected him President'. In the words of the indian scouts with Custer 'What's this we stuff?'

Dr. Bernacke's term ends early next year. He has done his best to take the wealth of the poor and elderly and subsidize those “greedy” bankers. Taxpayers now own $5,000B of mostly toxic debt. I have been an investor for almost 20 years, and I would never buy foreclosed or defunct debt for 100 cents on the dollar. The banks may increase lending now that they have fewer “non-performing assets”, but the 2009 bailout resulted in a massive consolidation but not much lending.

We are forced to give the government our hard-earned resources through government taxes/fees, borrowing and printing money. There are fortunately enough in government who believe that we have been Taxed Enough Already – although they are are in the crosshairs of the American Gestapo (IRS). The world has grown cold to buying U.S. debt. The Fed now buys the majority. Debasing the currency has been used since the U.S. became a debtor nation. What cost $1 in 1913 when the Federal Reserve Act was passed now costs $23.49. I have a $100Trillion note from Zimbabwe demonstrating the extreme result of debasing a currency. I also have a $5000 coin from Mexico. Clinton had to bail out our neighbor during his first term.

We have had 2 large bubbles burst already this century – the tech bubble and the housing bubble. There are 4 others set to burst, the dollar bubble, the government debt bubble, the student loan bubble and the personal credit bubble. Many nations want to replace the dollar as the reserve currency with a “basket of currencies” - the dollar, euro, pound, yen and yuan. This would be like SDRs from the IMF. The national debt is about $17T. Interest is about $400B each year with a 2-year Treasury note at 0.3% If the interest rate goes to 3%, then the interest will be $4,000B. The default rate on student loans is often more than 20%. Interest rates will be tied to the 10-year rate + 3.4%. This is currently 5.38% As home prices recover, Americans will again use the “equity value” in their homes as an ATM machine. It would be a great time to remember that the debtor is a slave to the lender!

Boy Scouting and Sexual Immorality

Scouting has existed for over a century. Men of character have provided leadership to boys and young men to become men of character. The BSA has decided that morally straight is no longer important and that sexual immorality is welcome in scouting. Men and women of character should immediately abandon BSA and move to Godly character-building organizations like Approved Workmen Are Not Ashamed (AWANA):

Excerpts from Margaret Thatcher March 1995

Sir Edward Gibbon (1737-1794), author of The Decline and Fall of the Roman Empire, wrote tellingly of the collapse of Athens, which was the birthplace of democracy. He judged that, in the end, more than they wanted freedom, the Athenians wanted security. Yet they lost everything—security, comfort, and freedom. This was because they wanted not to give to society, but for society to give to them. The freedom they were seeking was freedom from responsibility. It is no wonder, then, that they ceased to be free. In the modern world, we should recall the Athenians’ dire fate whenever we confront demands for increased state paternalism.

Capitalism is not - contrary to what those on the Left have tried to argue - an amoral system based on selfishness, greed, and exploitation. It is a moral system based on a Biblical ethic. There is no other comparable system that has raised the standard of living of millions of people, created vast new wealth and resources, or inspired so many beneficial innovations and technologies.

The wonderful thing about capitalism is that it does not discriminate against the poor, as has been so often charged; indeed, it is the only economic system that raises the poor out of poverty. Capitalism also allows nations that are not rich in natural resources to prosper. If resources were the key to wealth, the richest country in the world would be Russia, because it has abundant supplies of everything from oil, gas, platinum, gold, silver, aluminum, and copper to timber, water, wildlife, and fertile soil.

Why isn’t Russia the wealthiest country in the world? Why aren’t other resource-rich countries in the Third World at the top of the list? It is because their governments deny citizens the liberty to use their God-given talents. Man’s greatest resource is himself, but he must be free to use that resource.

capitalism encourages important virtues, like diligence, industriousness, prudence, reliability, fidelity, conscientiousness, and a tendency to save in order to invest in the future. It is not material goods but all of these great virtues, exhibited by individuals working together, that constitute what we call the “marketplace.”

Freedom must be informed by the principle of justice in order to make it work between people. A system of laws based on solid moral foundations must regulate the entire life of a nation.

I am an enthusiast of democracy because it is about more than the will of the majority. If it were only about the will of the majority, it would be the right of the majority to oppress the minority. The American Declaration of Independence and Constitution make it clear that this is not the case. There are certain rights which are human rights and which no government can displace.

The price of freedom is still, and always will be, eternal vigilance. Free societies demand more care and devotion than any others. They are, moreover, the only societies with moral foundations, and those foundations are evident in their political, economic, legal, cultural, and, most importantly, spiritual life.

Birthright Citizenship and the Constitution

Many people by deceit or ignorance state that any child born in the United States is automatically a citizen of the United States. This was “birthright citizenship” in 17th century England. The United States Constitution 14th Amendment places two requirements for citizenship: 1) born or naturalized in the United States; 2) subject to the jurisdiction thereof.

If the wife of a foreign diplomat who has diplomatic immunity gives birth in the United States, then the baby is not a citizen. We can also tell that a mother who enters the United States illegally is not “subject to the jurisdiction thereof.” I believe that the same is true for the unborn child, but suppose we do not know until the child is born. If the child ever commits a crime, then the child should be stripped of citizenship along with punishment for the crime. If the child shows allegiance to another country – by waving that flag – then the child should be stripped of citizenship.

Common sense fails many judges when they consider the words of the Constitution. In 1857 the Supreme Court of the United States (SCOTUS) decided in Dred Scott that no black of African descent could be a citizen of the United States. The Congress corrected this horrendous decision with the Civil Rights Act of 1866. The peoples' House is where such issues should be debated and settled.

Hooray for Rep. Louie Gohmert!

Earlier today, the White House announced that it was cancelling public tours beginning March 9 as a result of spending cuts mandated by sequestration.

Representative Louie Gohmert (R., Texas) has filed an amendment to the House GOP’s six-month continuing resolution that would bar federal funds from being spent on President Obama’s golf outings until public tours of the White House start up again.

And the Debt Goes On!

I am having trouble believing that the American people are so clueless about debt. You cannot continue spending more than you take in. Suppose that you take in $2,900/year and spend $3,800. That is a deficit of $900/year. Suppose also that you have current debt of $17,000 and long-term debt of $71,000. You agree in August 2011 to immediately increase your current debt limit by $1,200 and cut your spending by $120/year for the next 10 years. When the first actual cut is due (19 months later), you say police, firefighters, teachers and children in Head Start will be homeless on the streets.

In the SOTU Obama talks about deficit reduction – never debt reduction. In my example this means spending $3,680 and a deficit of $780/year. For actual debt reduction to occur, the federal government must run a surplus. A balanced budget only stops the bleeding. The Senate has ignored the budgets passed by the House, and the President has not proposed even a balanced budget. The federal government has run on continuing resolutions (CRs) for years. This means that programs that existed 4 years ago are still funded at the same level. The program may have ended or be unnecessary, or it may be counterproductive to the current economy. Congress and the President keep funding them while increasing the debt.

The Federal Reserve keeps buying Treasury Notes and toxic mortgage debt. This artificially stimulates the government to spend and the banks to lend. Unfortunately stimulating the banks has caused consolidation rather than increased lending. The 10 banks bailed out with $125B of taxpayer money in 2009 now control 77% of the financial industry. If they were “too-big-to-fail”, then now they are “too-bigger-to-fail.” This money printing by the Fed also causes inflation – an illegal tax since only the House of Representatives can take your money by Law.

The “housing bubble” was partially caused by by low interest rates at the Fed over-stimulating the real estate industry. Fed rates are near 0%, and new bubbles are about to burst. The President talked about his college scorecard, - although the employment data is not available – you can see that colleges are graduating small percentages while the students are walking away from the loans. Colleges are admitting students who cannot compete.

Ponzi schemes like Social Security need new blood to pay for promises to the elderly. The liberal Supreme Court said in 1973 that it was “legal” to “terminate a pregnancy.” Since then over 55 million babies have been murdered. The United States demographics is now wrong for a Ponzi scheme to continue much longer. This is why Progressives desperately need immigrants to fill the gap - and vote for them.

It is illegal to bribe a voter, but it is “legal” for the FCC to charge “fees” on cell phone bills and use the money to provide free cell phones to those already on federal transfer payment programs. The inarticulate woman in Cleveland explains why the Progressives were re-elected. You cell phone bill payers provided the bribe!

And the debt spiral continues!

Lies From the State of the Union

Barack Obama, aka Barry Sotero, is the Liar-in-Chief. He has been successfully conning the American people for a decade. He probably went to Occidental College as foreign student named Barry Sotero. We are not allowed to know because his records are sealed, and Attorney General Holder works for Barry.

In the State of the Union (SotU), Barry stated “Corporate profits have rocketed to all-time highs – but for more than a decade, wages and incomes have barely budged.” Corporate profits may be higher for some companies, but this is artificial. The Federal Reserve is monetizing the debt ($85B/month) while subsidizing banks by buying their toxic mortgage loans. This stimulates the economy and the stock market temporarily like putting $50K of profligate spending on a credit card makes you feel better until the bill has to be paid.

The country has been in recession since 2008. Wages do not normally rise in recessions. If productivity declines, then wages should decline also. If productivity increases due to increases in automation, then wages should not increase. Wages should only increase if workers' own productivity increased separate from capital investment.

Over the last few years, both parties have worked together to reduce the deficit by more than $2.5 trillion – mostly through spending cuts, but also by raising tax rates on the wealthiest 1 percent of Americans.” The Federal government spends more than it takes in. It is not possible to reduce debt unless there is a surplus. Even if Obama reduces the deficit from $1T each year to $800B each year, the debt will continue to grow. The rating of U.S. Debt has already been downgraded, and it should be again. We have no budget, and it would not be balanced anyway. There is certainly no surplus!

The agreement in August 2011 gave Obama an immediate increase in the debt limit. The promise of spending cuts is still only a promise. Sequestration – delayed by a CR - should take place 1 March, but the cuts will somehow be avoided. Obama will try to blame others for an agreement which he signed. He states “In 2011, Congress passed a law saying that if both parties couldn’t agree on a plan to reach our deficit goal, about a trillion dollars’ worth of budget cuts would automatically go into effect this year.  These sudden, harsh, arbitrary cuts would jeopardize our military readiness.  They’d devastate priorities like education, energy, and medical research. They would certainly slow our recovery, and cost us hundreds of thousands of jobs. That’s why Democrats, Republicans, business leaders, and economists have already said that these cuts, known here in Washington as “the sequester,” are a really bad idea.” But Mr President, it was YOUR idea. The courts must understand that point-in-time political compromises like the “three-fifths” clause and the slavery amendments are exactly that: point-in-time rhetoric. They should not legalize abortion or anchor babies or make states rights subject to Federal judicial review. We learned the futility of legislating the morality of factions with prohibition and its necessary repeal.

Why a Carbon Tax is Unnecessary and Harmful

There will be climate change in the next 6 months. The northern hemisphere will get warmer, and the southern hemisphere will get cooler. This is mostly because of the obliquity of the ecliptic (see axial tilt). Other reasons are the water cycle (clouds), the Earth's magnetic field (shielding from high-energy particles), man's (and woman's) abuse of resources, etc.

Our government sees this “crisis” as an opportunity for a carbon tax. This will not change any of the above, but it will increase the power of the government and the costs of doing business.

The North American continent is rich in resources. The President and his Energy Secretary have done their best to prevent domestic production of these resources. Trillions of dollars of American capital have gone to OPEC and others who hate us. We could have been energy independent. Our unemployment rate could have been 4% or less instead of 8% or more.

In the 19th century, lamps burned whale oil. This was replaced by much cheaper kerosene. This was because that greedy capitalist and entrepreneur John D. Rockefeller was an extraordinarily efficient and effective manager. Later a waste product from the refining – gasoline – powered new internal combustion engines. Cars powered by gasoline beat the competition powered by electricity. Now 95% of vehicles are gas-powered.

Is CO2 a pollutant? It is necessary for plants to live. Plants are necessary for humans and animals to live. Have I endangered the planet if I exhale or open a carbonated beverage or roast marshmallows on an open fire? Only the junk scientists with a vested interest in “global climate change” would answer “Yes.”

The Clean Air Act and the Clean Water Act have made our air and water the safest on the planet. They have also made the costs of doing business in the United States much higher and have encouraged business folks to locate production facilities overseas. Millions of American jobs were never created.

The solution is to make reasonable tradeoffs with our planet. If lumber is needed for homes, then harvest older trees and plant many more trees to replace those taken. If carbon-based energy is used, then make it as clean-burning as necessary.

Obama Appointments Illegal

In an embarrassing setback for President Barack Obama, a federal appeals court ruled Friday that he violated the Constitution in making recess appointments last year, a decision that would severely curtail the president's ability to bypass the Senate to fill administration vacancies.

The three-judge panel of the U.S. Court of Appeals for the D.C. Circuit said Obama did not have the power to make three recess appointments to the National Labor Relations Board because the Senate was officially in session ”and not in recess” at the time. If the decision stands, it could invalidate hundreds of board decisions made over the past year.

The court said the president could only fill vacancies with the recess appointment procedure if the openings arise when the Senate is in an official recess, which it defined as the once-a-year break between sessions of Congress.
